Inherent Risks of Kayak Use

The use of kayaks, canoes, and related paddlecraft (“watercraft”) includes, but is not limited to, the following risks:

1. Entering, exiting, or falling from watercraft
2. Capsizing, sinking, or loss of control of the watercraft
3. Collisions with other participants, watercraft, docks, vehicles, or natural/man-made obstacles
4. Changing water conditions including currents, waves, tides, and water levels
5. Adverse or changing weather conditions including wind, storms, temperature extremes, and lightning
6. Cold and heat-related injuries including hypothermia, heat exhaustion, dehydration, and sunburn
7. Drowning or injury due to water immersion
8. Physical exertion, fatigue, or diminished coordination and reaction time
9. Equipment failure or malfunction, even if properly maintained
10. Contact with wildlife, vegetation, or environmental hazards
11. Limited or delayed access to emergency care or rescue services

Transportation & Handling Risks

I understand and agree that transporting rental equipment involves additional risks. I accept full responsibility for:

• Loading and unloading equipment onto vehicles
• Properly securing watercraft using straps, racks, or tie-down systems
• Any damage to the equipment, my vehicle, or other property during transport
• Any accidents, injuries, or incidents caused by improperly secured loads

I acknowledge that improper transportation of a kayak may result in serious injury, property damage, or death, and I assume all risks associated with transporting rental equipment.

Assumption of Risk

I acknowledge that participation in kayaking and handling rental equipment involves inherent risks. I voluntarily assume full responsibility for all risks, both known and unknown, including those not specifically listed in this agreement.

My participation is voluntary, and I choose to proceed despite these risks.

Responsibility for Myself and Minors

I certify that I, and any minor(s) under my supervision:

• Are physically capable of participating in kayaking activities
• Understand the risks involved
• Will follow all safety instructions and applicable laws

I assume full responsibility for all injuries, damages, losses, or expenses incurred by myself or any minor under my supervision.

Medical Responsibility

I understand that I am solely responsible for any medical treatment, emergency care, or evacuation costs resulting from participation or equipment use.

Release of Liability

In consideration of renting equipment, I hereby release and discharge:

Bill & Paul’s Sporthaus, its owners, employees, and agents

from any and all liability, claims, demands, or causes of action arising out of or related to:

• Use or misuse of rental equipment
• Participation in kayaking or related activities
• Transportation of rental equipment
• Including claims arising from negligence
